legal.. ?

Post by lozz »

Icarnt fecking believe this..
Just had my pug seized by some biatch in a traffic car..
I went round a bend/empty quiet road about 30mph..

Next thing I've got the blue lights.. stops gets out and went to the driver of the bacon car,
She says get in the back.. no manners from her ..propper arrogant ..

So I gets in the back,

Her first words was. You took that corner a bit fast didn't you,
Reply.. if you say so then fair enough,

Then she says I'm reporting you for dangerous driving..
I then said fair.enough,
I then asked her did she have video evidence plus a recording of what speed I was doing on a calibrated device
She said no.. so isaid OK fair enough,

She then says I'm going to breathalise you.. OK
Came up clear,

She then turned to the car .. how long have you owned it..
Reply... sorry but I think your wasting your own time .. your vehicle is equipped with a.n.p.r I've already given you my name address blah de blah.. and you have a.n.p.r. you will have all my details there..

Her reply was, a.n.p.r doesn't work like that

Oh OK.. she's bullshitting I thought but ididnt comment I thought feck it bite your tongue..
At this point she's still getting arrogant, but iwasnt biting back..
If it was a male officer I'd of lost it with the %$&?..

Next thing she says is your photo card licence as expired..
So isaid sorry but it hasn't expired,, she says yes it has..

Isaid how can it expire when idont/have and never have had a photo card licence
I've got the old paper style one.. I'refuse to pay for a price of plastic...
Now look on your system again.. then call me a liar.

She then says I'm seizing your vehicle..
Itold her to contact dvla... she says icarnt there closed.

I've emailed my solicitor, so hopefully ican have this bitch pulled in,
I know the plod take some grief but I gave her non .. I can understand now why they get so much abuse
If that's the way they treat people..

What the f*ck? I thought they could only seize cars that were untaxed or uninsured :? I guess your lawyer will be able to tell you.

That's what I thought too mate,
For some unknown reason they've got me down as expired licence holder
The plastic ones expire after. 10 years according to my wife,
Mines the older paper type, of which was supposed to be valid until I'm 70

I'm going to take that down to the bacon shop later and see if ican speak to the headhoncho..
Iaint paying 150 quid plus 20 storage fee when I've done feck all wrong..

Admitidly, ishouid of really got one of these fecking plastic cards with my ugly mug
On it but.. I've always felt. Wtf. Why I've passed my test and I've got the paper one
Valid until ..I'm 70

Another thing that's puzzled me is if she's got me down as expired plastic licence holder
Surely I'd or shouid of been booked for no insurance too..

The licence issue wouid invaladate insurance too I'm thinking,
My insurance wasn't questioned, company name etc wasn't asked for.. :?

I'm going to have them on that.. perhaps stick a compo claim in too,

The only way your in the system as a plastic holder is if you've applied for one before (or someone else has?) I'd be asking for proof of what she saw on that screen because someone could be driving about on your licence :?

You don't need a plastic one my mrs work was doing those council checks and she was asked for photo id which prompted her to look into the legality of the old paper licence which we both still have... I think mine is made from flint. :supafrisk:

Are you absolutely 100% sure you were only doing 30?

Either way, I was under the impression that all driver's licenses in the EU were valid until you're 70, not matter if they're paper or plastic. I know mine is, the only expiration date on it is in 2055.

Good on your for going to your solicitor, if everything happened as you wrote, she had absolutely no grounds for seizing your vehicle.

I would agree that a solicitor is the way forward. Be very careful of what people online tell you in situations like this.

I don't think a Solicitor will be interested in this one bit.

There's no way a Police Officer (Male or Female) would pull you over, get shirty with you, and have your car seized without good reason. Sorry lozz but I think there's a bit more to this, maybe you've moved house in the past and failed to update your licence? maybe the car's showing as uninsured for some reason?

I understood it was mandatory, particularly following an address-change, to have a Photo Card Licence in the UK since around 2001 ish?

Hope you get it all resolved though and let us know what happens, but me thinks you're better being compliant than making a fuss with them.

My missus had a minor fender-bender in 2002 and she had forgotten to do the address change on the Driving Licence (we'd moved only a couple of months before), they took it that seriously it took a final letter from the Chief Constable that he'd decided to 'let it go on this occasion as no-one was hurt' before the matter was dropped

I've been in to see the cops
Solicitor went in with me..

I've got the car back .. didn't have to pay release/recovery fee.
My licence is still legal.. but I've been told a photo card licence is required by law
I'm looking at up to a grand fine for not having one. But according to them I've got an expired one,

So I' will get something in the post for that
And also the dangerous driving ..

The solicicitors cost arnt cheap but .. its worth every penny..

I'm going to send off for a photo card licence.. phuck it if it saves all the hastle of all this.b/s

I was driving like a %$&? admitdly .. but early hours on a open stretch no houses etc just open land that used
To be wagon routes to the old mills..

Ah well lesson learnt there.. :(

That's very odd!

You're perfectly entitled to have a paper license, unless your details change it'll stay valid until your 70th birthday. There is talk of phasing them out but forcing people to pay for photocards is a bit controversial, so that decision wouldn't be popular with voters, hence they'll wait until there are very few left. Mine expires in 2042 :cheesy:
The AA wrote:Paper licences
If you still have a paper driving licence you don't have to worry about ten yearly updates though you must still notify DVLA of name or address changes.

Parliament has given powers to recall all paper licences so the more secure photocard licences will be held by everyone, but no date has been set for this and the government is well aware that it would be controversial to make everyone buy a new licence.

The AA has said that if the government insists on everyone changing, it should phase in such a move and subsidise the cost.

Keeping the details on your paper licence up to date will ensure that DVLA is able to tell you when this is happening and if you need to do something.

The confusing part is there adamant that I've got an invalid/expired photo card licence..
And I've told them until I'm blue in the face that ihavent..

At no time have I applied for one :?

Unless someone else has in the past in my name... :?
But icarnt see how that's possible or why

So I've worked out. Photo card licence disables the paper one
And a out a date photo card is as good as driving with no licence... %$&? arnt they :frown:

Not quite, the paper (counter) part IS the licence as it records penalty points and stuff, the two licenses go together in effect.

The Photo Card is really a small convenient summary of your entitlement to drive and of course a mug shot to prevent fraudulent use.

I believe that it is an address-change which forces you into having to get a Photo Card.

Wellys right. A photo card licence is both parts, the card and the paper bit. To be a valid licence you need both parts. We sometimes get people turning up for a test with just the card, if you do that, no test. Silly system, but there you go.
And they won't issue another paper one if you change any details, they make you have a 2 part photo one.
Mind you, the photo card is quite useful for proving who you are.
